The SOSCAST hosted by Adam Sosnick is a pop culture financial podcast that breaks down Lifestyle, Relationships, and Money.
The divorce industry industry needs to be held accountable. In the Nordic countries the marriage and divorce rates are the same as the rest of the world but men have guaranteed access to their children and alimony is fairly distributed. People don’t go broke going through a divorce. Fix that and men will come back to the table, IF they’re still interested.
💥💥 I just watched the documentary about this woman who hired a hitman to kill her husband so she can collect the life insurance, lucky for him his friend over her the conversation and informed him and the husband informed the police and the police and husband staged his death and they had his wife on camera laughing after they showed her the pictures of him being fake dead. She ended up getting like 20 years of prison. I don’t see why anybody would want to get married when you have risks like that I would just not deal with that type of BS. There is exactly no benefit to a man getting married in today’s age, women hold all the cards in everything. That’s her house she’s deciding what the kitchen look like she’s going to decide what the bedroom look like she’s going to decide what type of wall paper and cabinet you put in the bathroom etc She’s going to decide what to buy during holidays heck she’s going to decide if you celebrate Christmas you may be a guy who like myself is not even into celebrating holidays but I’m forced to celebrate it because she wants to celebrate it. Y’all go to the movies you mostly going to go and see what she wants to see. The man spends far more money in the relationship than the women does like I just don’t see the benefit of marriage for men. And also when you get married you have less sex than a guy that’s single because your wife dictates when she wants to have sex. Then there’s the financial stability like me I’m a single man, I work two jobs all of my money from both of my jobs go to me and to me only.
Marriage rates going down and that trend won’t change any time soon, and the idea of guys being alone it’s true, break ups, divorce anything and apart from being left alone there’s also the element that people do tend to screw you over already adding to the whole disaster like a grenade with mini grenades inside of it. So it’s definitely something to contemplate with utmost caution but hey some people say unicorns exist maybe… Just maybe… We could all find a unicorn. Bless
If women were expected to assume the same risk as men, I wonder how many would consider marriage? My guess would be less than 10%. When asked why I don’t want to get married my response is a simple one. If I agree to get married, will you assume the financial risk if it fails? How many takers do you think I get?
years back a bunch of us were at a new years eve party. one of my buds got engaged that night in front of all of us. we all went up to congradulate them. one of my buds goes up congrats them then turns to all of us and in front of his own wife and says. why should he be happy. and the marriage after all that lasted all but 2 yrs. dont get married. stay single and raise your kids that way
I hope the man who spoke first has a marriage that lasts a lifetime. I really do, but one has to look at statistics. From what I have read, divorce rates are at or close to 50%. In Christian marriages, it is slightly less. One has to ask what the root issue is, and I assert it is because there is no longer a stigma around divorce like there used to be. It is far easier for someone to throw up their hands and file for divorce, and the lower earner (typically the wife in the past), usually gets taken care of for life, or for a significant amount of time. In 2023, there should be zero alimony paid to another person. High earners, realize that when you marry someone, you will be forced by family court to maintain their lifestyle, even if they cheat on you, spend all of your money without you knowing, etc. It is basically the state’s way of forcing you to pay for your former partner’s welfare. In my opinion, it isn’t worth it to get married in the slightest.
How does Hafeez have any credibility at all? What I have seen of him in various clips is completely lacking in statistical data. Show me the statistical breakdown of ALL of marriage. The divorce breakdown through the staying-together-for-the-kids and into the FRACTION of a percent that are in a 50 year plus happy marriage. If you are not willing to obtain that data, even if you have to commission a study yourself, then I am going to have to side with CGA and the RedPill Men Guarding Their Own Wallets.
I once knew a couple that was married ten years. No children. The woman worked. The man laid on the couch and did nothing. She finally figured it out and divorced him. It cost her an arm and a leg, but she was well rid of him. Husband 2 was a great guy, as was husband 3, and as is her current boyfriend. Now here’s the point. Can you seriously say husband 1 did not benefit from 10 years of marriage? Would you seriously tell that bum not to get married? Hell no. That dude greatly benefited from the institution.
My grandparents were married 80 years. If you can’t have a marriage over 20 years it is your fault for not knowing yourself and getting into a relationship. You have lied and fooled yourself and your significant other and at the end you say it’s just not working out. No you just were not putting in the work for you and your spouse and your family. There is no easy way out of life. And everything good comes from hard work, persistent, and passion. Grow up and man up
I say DO NOT GET MARRIED!! Not even with a prenup. DOMESTIC PARTNERSHIP is the best way to go if you MUST do some form of commitment. It is still a commitment, she can’t take ANYTHING FROM YOU BECAUSE YOU ARE NOT MARRIED. Domestic Partnership only advises the government that you two are together in a committed relationship and you live together.
Marriage isn’t complicated though. Love is easy when you put your spouse above yourself. When 2 people do this…there’s happiness and joy and both people’s needs get met. People divorce because they have a hard time putting their spouse above themselves. Marriage isn’t for the selfish. Period. Stay single if you can’t esteem your spouse above yourself. Singleness is for selfishness – marriage isn’t.
Hafeez is just one of those ninjas that’ll still skydive using a chute with a 50pct chance of opening. No offense to the younger guys out there, but this guy really doesn’t have enough life experience to be guiding men……if he was realistic about things and not idealistic, then I’d take him more seriously.
My Chinese wife and I – I am Caucasian American male – celebrated our 50th wedding anniversary back in Sept. 2023. Best wife in the world! But no doubt young women now are dangerous to marry. Seems to me the lack of religion by both genders of these young generations is the absolute first red flag. (My wife and I are Catholic.) Marriage is a sacred vow to God, not just each other. Marry a COMMITTED Christian girl. Be sure you the guy are committed also. 100% guarantee, no, but up there in the 90s. I would say the Philippines and Thailand.
Hafeez is correct about the nihilism part. The only alternative to marriage is The nihlistic incel Type life and I genuinely refuse to believe coach Adams feels fulfilled. We look at happiness like a life goal which is the problem because you will always be chasing it. And nihilism isn’t the answer. Even though coach is right about how F’d up the courts are and that’s a good reason not to be married
1Timothy 4:3 states that those men who forbid marriage do not know the truth and are in error. Telling men not to get married is unbiblical, irrational, immoral and uncivilized. This man is feeding men with false knowledge instead of telling men to be wise and discerning in picking a wife. We know that it is not easy to find a wife in this current environment but is even more reason to equip and furnish men with the proper knowledge to apply in finding a good woman. Marriage is good, men just need a good woman to share it with.
I will never listen to a guy that’s only been married one year and then top of that if you are not married to a western modern women you cannot speak on this topic because the coach is literally speaking on modern Western women the emotional guy is not married to a western women so he has no idea what he’s talking about
I worked for a law firm criminal and civil for over 15 years, the fact that, the women mentions specifics on common law marriage raises a HUGE red flag for me, she knows that she doesn’t need to be legally married to receive support and in certain states if the man and woman can not come to an agreement a judge will settle everything just as if you were legally married with a marriage license, and i am still waiting on just 1 benefit for a man to get married..
I know a guy that built a house himself on a nice piece of land overlooking the river in the mountains..met a women afterr it was done married her two to three years later. She filed for divorce after 3 yrs. The judge gave her the house and the land and alimony and child support. The man couldnt afford and apartment had to move back into moms house. Tell me how that is fair and right
I am not a lawyer but been divorced for 20 years. Here’s what I have learned about common law marriages. Most states its a period of 5, 6, 7 – 10 years. For that common marriage to be valid you both must share community property i.e buying furniture, cars, and property together. Further, if she changes her mail address to yours she then is establishing residency at your home over time. Don’t let her do this. Also, how much time she spends 5 days vs 2 days at your home leads to what we call “Constructive” marriage i.e events leading or that can lead to. Same doctrine as constructive gun laws. Also taken into account is does she has direct access to the property i.e keys, security codes and what not.
All laws protect women. Add “if you divorce because you’re not happy, you get nothing, kids stay with the man” in government contract, add mandatory paternity tests before signing the certificate with full financial responsibilities, remove common law, cohabitation and other bs, then men would consider signing it.
Check your state laws for common marriage, and talk to a lawyer before you let her move in. “Adverse possession”, which is sometimes called squatters rights, is the doctrine under which a squatter could acquire a property’s title without buying it. To claim squatters rights in Minnesota,Ā a person must live on the property for at least 15 years and pay property taxes for five.
To the men who work hard and earn avg income – dont worry. Just look at how they laugh at you – leave those gold diggers to the simps who fall for their cheap manipulation tactics. Those simps will eventually find out they’re only interested in their 💰💰💰 If you start to doubt it, just go back to the clip where they laugh at the thought of a man not being wealthy enough for a prenup and thank the stars you dont have to deal with that
I’m so glad that this type of information is available to younger men. I and many others had to find out the hard way without having older male advice around or the internet If your marriage fails for any reason, you can be screwed in divorce court and all those women in the article know it. Also, a couple of them come across as entitled and cold hearted i.e. They will marry a man they are not into for money reasons. For any woman reading this I love women, I love punnany but I don’t like the laws in America when it comes to marriage.
My thoughts just now is that marriage as a legally binding civil contract has failed society in what it has become. What it seems to me is that with things like prenups – people are saying, yes, I want some kind of legal contract and commitment and protection, but the current state of what the state provides is horseshit and I don’t like the idea of the state dictating terms and outcomes, so we’re going to build our own contract. And maybe that’s how it needs to be – no more one size fits all state dictated cram down. People decide their own terms and conditions and the state honors and enforces that. This way, people get the terms they want that they think are fair and best serve their interests, plus get the benefits of state sanctioning to enforce the contract, provide the protections they people want for themselves, and the security that people need and want to build families.
In Texas for a common law marriage case to be made, you still need the marriage license filed at the court house, or some kind of bonafide marriage agreement. If there is no written agreement, then common law marriage can be dismissed pretty easily, especially if you file your taxes as single the whole time instead of married. so guys, file your taxes as single if you have never signed a marriage certificate.
The fact that’s these women are quick to know the facts about these contracts such as prenups just good to show there mindset and that there banking on these things as their out. Not many men even think about these aspects, don’t let their innocent act fool you their understanding of the laws can make most lawyers seem foolish.
According to what I have been able to find and read there are currently only 8 states (including D.C.) that will recognize common-law marriage, and although they have their own rules and policies in place generally speaking you would have to file in court for that marriage to be considered for recognition and it does not appear to be automatic.
Whats the difference? The difference is called GREED. A successful man should NOT be giving 50% of a successful business or endeavour to a woman in a divorce., especially since she is the one that most likely initiated the separation. There should be NO incentive to call it quits. If she wants out, then she wants out, but she doesn’t get to walk away with 50%, its ridiculous. An equitable amount is fair, enough to raise the children is fair, but if you want to see greed take a look at the results from any high profile divorce and you can see overwhelming greed run amok. Kevin Costner for example was paying $130,000 a month in Alimony. That is the very definition of overwhelming gluttony. Unless his Ex-wife was taking care of 130 children, she doesn’t need that amount of money.
Quite a few states have some form of Common-Law marriage. And MOST of those states require the “intent to be married” and the couple must “represent to others that they are married” as a condition of the status. What the young lady was actually referring to is Community Property laws. However, a person may very well find themselves in a court room, trying to convince a Judge that the person you were with for years is not your common law spouse, when you TREATED them like a spouse for years and referred to them as wifey/hubby both in private and public!!!!
Common law doesn’t take into account assets you didn’t come to the relationship with. Meaning, if you came to the relationship with nothing and he has a million dollar home with assets and can prove he had that before you, then you’re not entitled to half of that. But if that home appreciated in value during the common law period, then you’re entitled to half of the gains (the portion above what he had before you).
Women live in the moment. When she says she wants to be with you, that needs to have added at the end of the sentence ” for right now, at this moment.” Women and their feelings change, and this moment might not be the same as in how she feels at the moment in 10 years. Then, she feels differently and wants a divorce. Anything a woman says…. You must always add to the end of the sentence…. “This is how I feel, right now, at this moment…. subject to changes in my mood and how I feel, later.” Two things for a man, you should get a vasectomy if you’re playing the field, and you should never, ever mention or say a word about ever getting married.
Whatever the default divorce laws state for the division of marital property or family court custody and visitation precedents are in any state is essentially a generic prenuptial agreement. A prenuptial agreement only customizes how things shake out that’s not based on the whims of a judge or the statutes written in a different time and politically influenced.
🔥🔥”Eight states currently recognize common law marriages: Colorado, Iowa, Kansas, Montana, New Hampshire, South Carolina, Texas, and Utah. There are also some states such as Ohio and Pennsylvania that used to allow common law marriages and still recognize them as valid, but they have since changed their laws.” This Lady is delusional and is not telling the whole truth. She Said “MOST STATES RECOGNIZE COMMON LAW”. Besides Texas, who lives in any of those other states??? In other WORDS Common Law Marriage for Most of the US Doesn’t exist. I lived in CA my whole life, I even looked this up, CA ONLY recognizes this if a couple was married in Another country, so that marriage would transfer over to CA. Anyone can Simply Google Common Law Marriage.
Gosh, Natalie is such a Lame. No wonder she aint married. She said getting married is an investment to happiness, having a family, and rationalizes it by saying get a prenatal agreement 🙄🤦🏽āāļø. As if we dont know already 1) they don’t work or can be contested, 2) it would cost me, the Man a lot of money to get, all just for this “commitment”. DF! We can get happiness, kids, family, and everything else w/o a marriage. Why risk severe Financial hardship and emotional trauma with a marriage?
Agree in today society marriage has a lot of disadvantages and difficulties. And that not including how complicated insecure, emotional sensitive and don’t know what I want, and let not forget how easy a woman get bored and ended in someone’s bed there husband caught her in the act and when try to divorce her he ended losing EVERYTHING thanks to the system that give everything to a woman. But it shouldn’t be when she is the one that committed the adultery. We living in a different time, long ago was great but not now.
After perusal this show…it just reinforces my decision I made back in 2007 to give up dating EVER AGAIN! Women are impossible/feel hella entitled! 51% of all marriages end in divorce…women initiate 80% of divorces…women get custody of the kids 95% of the time! Those numbers make it a bad risk for men to get married (or even live with a woman). If I were to meet someone who liked sports and poker…I’d be down for dating. However I will NEVER, EVER live with a woman! My money is MINE…my time is MINE….my freedom is MINE! When you live with someone…breaking up is sticky (especially if enough time has passed where the common law BS nonsense comes into play).
She’s telling you she will not be with you or trust you if your are protecting yourself from her bailing, while she is already protected and guaranteed when she bails out without even thinking of a prenump. She already has one going into the marriage and has the ability to steal your stuff. She gets to go in expecting it to fail if she is demanding a marriage without a prenump. Why does he never say something like this to them when it’s so simple to understand.
In the United States, as of 2022, common-law marriages are still recognized inĀ Colorado,Ā Iowa,Ā Kansas,Ā Montana,Ā Rhode Island,Ā Oklahoma,Ā Texas, and theĀ District of Columbia, whileĀ UtahĀ andĀ New HampshireĀ have limited recognition of common-law marriage. Of the remaining 41 states, 13 never permitted and 28 no longer permit common law marriages to be contracted within their jurisdiction. The latter group will only recognize a domestic common law marriage if it was contracted in the state prior to the date of abolition.
7:54 she didn’t like the idea of a prenup because that’s basically the man having an escape route. But an escape from what? She’s basically implying that there’s something to escape from, proving the point of why men should have a prenup. Also, it sounds like she’s more concerned about marrying through court for contractual leverage than marriage itself 😂
Marriage should not have been this difficult. The problem is the judicial system which destroys a man’s life during divorce. That’s what men are running from. If there is a 53% chance that your marriage may end up in divorce and your wife taking half of your life’s work, why do you enter to marriage?
1. Wmn are great economists. 2. They only do business when they can improve their present reality. 3. They will say all the right things at the right moments until they feel they won the prize. 4. Men are great optimists. 5. If they believe something might be of benefit, they go all in, even if they have to lose first. 6. The problem is that marriage is a bond you make with the State. You allow someone to decide what is right and what is wrong during and after the union. 7. Wmn know this… but men didn’t know until now. 8. Life is a game of leverage, power and options. 9. Marriage can put all 3 at risk.
The most popular anthropology theory is that marriage was initially made for men. As a way to establish paternity and make a way to pass down his wealth and name (happened around the time we evolved into civilizations out of hunter gather based societys where land and weath could be accumulated and passed down). Today, I do believe the practical purpose of marriage is to provide stability to children. So, outside of children and religious reasons I can see why people don’t want to get married. If women want marriage, than they need to set up reasonable boundaries. Like, not mixing finances or being financially dependent on a man before marriage. Also, not having children before marriage (and leaving men who say they don’t want marriage). Furthermore, if you do get pregnant by accident and the man still refuses to marry you, the kid shouldn’t inherit his last name. My rule, if I grew and birthed a child, its going to have the same last name as me. If the man doesn’t want to give me his name, than he doesn’t get to give the kid his name either. All this is to say, if you want marriage, set boundaries and stand by them. Otherwise, don’t complain when you sell the milk for free and he winds up never buying the cow (crude, but you get the point). If you’re not willing to do that, then don’t get pissy when men trample over a woman with no boundaries. I think he is of low moral quality, but society got rid of sexual morality a while ago so we can’t continue to operate as if that value/assumption is shared.
I’ve been married for 47 years. How did we make it work? We worked at the rate of 110% each. It’s not easy. But! We are 100% committed to each other and nobody else. We have been 100% faithful and never cheated. We were both virgins before we married. And we both had plenty of chances. She is still gorgeous. She’s never been overweight and the hardest worker I’ve ever known. She’s never had a job outside the home, though she made some money through her in-home hobbies. I’m the primary source of our income. We have 7 children. They are all grown and make more than I do. We taught them all at home when it wasn’t popular. To make it work, you must be honest, moral, and committed.
They’re fine with it because divorce favors women. You rarely hear about women getting hosed in divorce court. Everybody goes into marriage with the best of intentions, yet still life gets in the way and the divorce rates are where they are across the board. Men, if you think you can beat the odds of divorcing, go ahead then. I wouldn’t recommend it. You’ve been warned.
Instead of a prenup, you need to arrange things so that you own nothing and have as little income as possible during your marriage. Put property vehicles and other items into a trust. If you have too much money coming in, have regular deductions going to your parents, poor relatives or a charity, before you get your actual pay. I don’t know exactly how to hide income. Assets can be hidden though. If your trust(s) own(s) all your property and vehicles and your wife stays and never files, no problem. If she does file, you don’t own these things.
To be exact, as of 2020, only eight states still allow common law marriages to be formed in them. An additional five states allow common law marriages, but only if those marriages were formed before a specific date (meaning new common law marriages are allowed). However, all 50 states must recognize common law marriage validly created in other states that allow them. So if you formed a common law marriage in a state listed below and then move to another state, your new state will be forced to recognize your marriage as valid. If children are involved-naturally child support kicks in.
In the US, common law marriage is very rare and has more requirements than just living together or even having children together. Only a few states even recognized common law marriage. Cohabiting alone does not confer any rights. The parties must prove that commitments and guarantees were made. PROVE not just allege.
Washington state the woman is entitled the same rights as a married woman after three months of living together. Never be afraid to live alone for the rest of your life gentlemen once you get married once you live together, you’re putting yourself at risk. If she really loves you that she doesn’t need you to sign a contract and she doesn’t need to live underneath your house or you live in her house which will obligate her to your resources that you worked for. She will keep it real. She will keep it fair if she really loved you. Girl in the green shirt, you are too young and inexperienced to make the points you’re making trust means nothing after 10 or 20 years when people think completely different than they did the day they met each other
She needs to talk to a lawyer. Common law marriage is not 3 years and there is only a handful of states that still recognize it. Also, it’s not JUST living together. You also have to PRESENT yourself to others as husband & wife. So, like SOS said in his scenario….. did you have a ceremony without the paperwork and go around calling this person your spouse. You don’t just live with a person and take half their stuff. Women are a trip! And to the argument of “you’re expecting this to fall”, you don’t buy a house EXPECTING a fire but when it burns to the ground who here wouldn’t be happy that they had insurance. You can’t go around in life thinking rainbows & unicorns especially with a failure rate of 50%. Please make it make sense! Haha
I generally agree that in a lot of cases, a state marriage is an outdated concept, however, once children are involved things get a lot more complicated on all fronts. In this case marriage offers a type of default agreement that makes reasonable sense to make sure everyone is protected. It is certainly possible to negotiate your own arrangement in lieu of marriage, but in most cases it is probably not worth it.
She was incredibly wrong about this. Directly from a female lawyer: “Common-law marriages being honored and recognized nationwide is a common misconception. In reality, only a few states acknowledge common-law marriages: Alabama, New Hampshire, Iowa, Kansas, Texas, South Carolina, Rhode Island, Colorado, Montana, the District of Columbia, and Utah.” It’s not in most states and it’s seven years, not three.
Common law marriages are not established simply by living together. Usually, both individuals must publicly refer to themselves as spouses, and there must be a commingling of cash and property. If your assets are clearly kept separate (i.e. separate bank accounts, deeds, etc), then it is difficult to establish a common law marriage.
For Common Law marriages to be enforced you have to 1. Not be married prior 2. Both parties have to be 18 years of age 3. BOTH AGREE TO BE MARRIED 4. Afterwards live together as a informal marriage couple 5. REPRESENT TO OTHERS THAT YOU ARE MARRIED. Just cause you lived with somebody for x amount of years and split up you are not entitled what a husband or wife gets lol NICE TRY THOUGH but keep in mind I live in Texas sooooā¦ā¦
The following states currently recognize valid common law marriagesāregardless of when they were establishedāeither in state laws or as a result of court rulings:\r \r Colorado (Colo. Rev. Stat. Ā§ 14-2-109.5)\r District of Columbia (case law)\r Iowa (Iowa Code Ā§Ā§ 252A.3.6, 595.1A)\r Kansas (Kan. Stat. Ā§Ā§23-2502, 23-2714(b))\r Montana (Mont. Code Ā§ 40-1-403)\r Oklahoma (case law)\r Rhode Island (case law)\r Texas (Tex. Fam. Code Ā§Ā§ 2.401, 2.402)\r Utah (Utah Code Ā§ 30-1-4.5)
The following states allow common law marriages. Each state has different requirements for a long-term relationship to qualify as common law:\r \r Alabama\r Colorado\r District of Columbia\r Georgia (if the relationship began prior to 1/1/97)\r Idaho (if the relationship began prior 1/1/96)\r Iowa\r Kansas\r Montana\r New Hampshire (inheritance only)\r Ohio (if the relationship began prior 10/10/91)\r Oklahoma (Conflicting laws, discuss with a family law attorney)\r Pennsylvania (if the relationship began prior 1/1/05)\r Rhode Island\r South Carolina\r Texas\r Utah\r If a court determines that your common law marriage is valid, you will need to obtain a traditional divorce.
Just follow these rules: 1. Live-in with your girlfriend. 2. Pay separate rent to the landowner. If you buy a house, make sure the girlfriend pays a rent to you every month in your account. You can pay her cash first as a gift or a loan, then she must return it as a rent to you every month. Open a loan account with her, and make her sign a loan contract with you that mentions that you pay money to her as a loan. 3. This will make your status as roommates and not live-in. So, you are 100% safe 4. If you want kids, sure, go ahead but without marriage. Keep your status as it is, which is roommates status. Because in the worst case if you break up, you would be paying only for the child support (which you should) for 50-50 custody, or weekends custody. But most importantly, you will not be paying anything to the lady.
Adam don’t compare divorce to a car accident because there are no such thing as accidental divorce. People get car/health insurance because of “accidents” that could end your life literally. When divorce happens it’s not because of accidents, divorce happens because of abuse or cheating, It’s a conscious choice and a person getting into a car accidents is not.
The easiest way to prove a common law marriage in Texas is to complete a Declaration and Registration of Informal Marriage form. (Tex. Fam. Code Ā§2-402.) The form was prepared by the Texas Bureau of Vital Statistics, and is a declaration (a sworn statement) that says both partners acknowledge and agree that they’re in a common law marriage. You’ll have to bring the form to the county clerk to be finalized and recorded. Once the form is recorded, it becomes prima facie proof of marriage, which means that the document, in and of itself, is evidence of the validity of the marriage. (Tex. Fam. Code Ā§2-404 (d).)
Having car insurance is important to have especially in the case of an accident. You don’t just drive and expect to have an accident. It’s the same principal with a prenup. You don’t expect to get a divorce but if it were to happen years down the road and statistics show it, a prenup would be a way to protect yourself. Because I’m pretty sure a lot of good men and even successful men thought that their ex wife was their soul mate and were gonna grow old together. 🤨
The optimum arrangement for a man is keep his residence and finances separate. Spend an hour with a divorce lawyer so he understands the laws in the state where he lives. There are currently only eight states that recognize common law marriage (I googled it): Colorado, Iowa, Kansas, Montana, New Hampshire, South Carolina, Texas, and Utah. Each state has its own specific rules for recognizing common law marriages so don’t live in one of those states. As long as he maintains the leverage in the relationship, and it is enjoyable to spend time with her, then fine. But to believe that the relationship will last till he dies is maybe a 10% chance.
It’s prenup or no marriage just that simple. Otherwise we both can keep it moving. Sad feelings will fade away over time, and new feelings can be obtained, but not so easy for reacquiring assets that you’ve worked many years to acquire. If you didn’t help acquire the assets you’re not entitled. I’m speaking for kidless relationships.
Common law is supported by the courts, however, if you maintain a separate residence then the common law marriage does not apply because the court doesn’t consider that the man and woman are living together. Child support always applies. Support payments don’t apply either because the man is not supporting mother.
The states which recognize palimony as a form of legal recourse include Alaska, Arizona, California, Colorado, Delaware, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Maryland, Minnesota, Nevada, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Rhode Island, Texas, Utah, Vermont. Also, prenups don’t cover alimony and child support. It only protects assets.
She is incorrect about most states honoring common law marriage. In the U.S., most states have abolished common-law marriage by statute. However, common-law marriage can still be contracted in Colorado, Iowa, Kansas, Montana, Rhode Island, Texas, Utah, Oklahoma, New Hampshire, and the District of Columbia.
Common law marriage is crazy. In some states ONE year living together can cost the guy half his shit. There was a case where a man and a woman didn’t even live together, but she stayed at his place 3 times within a year when she flew into his state (yes, they didn’t even live in the same state) and vice versa and the court let that count as co-habitation in a 1 year relationship. And common law marriage is something the court HAS TO follow. Prenups are NOT legally binding. A judge can simply throw it out. Especially if the woman claims she only signed it under duress – and duress being as little as that the wedding wouldn’t have happened without her signing – which judges have accepted as reason enough already. Men need to be aware of common marriage laws in their area AND know that prenups are not binding. DO NOT MARRY!
Living together is not the same as common law marriage. It also varies by state. In most states, you have to at least represent yourselves as a married couple in one “official” document – a rent application, credit card application, bank account, etc. And, that’s in the states with the most wide open, easiest common law marriages. Government sanctioned marriage shouldn’t even exist. As with most things, government involvement ruins an otherwise natural human relationship between two adults. If you want to be married, it would be just like baptism, first holy communion, confirmation, or other life milestones. You celebrate it with the people you love & keep the state out of it. All of the responsibilities are already cooked into case law. People shack up all the time. When they split, the courts still assign division of property & parental rights & responsibilities.
The fact that one party has to protect himself should say to everyone in the room that it’s an unfair system….. Why do we have to protect ourselves? Nobody should have to protect themselves in a fair system… The pronuptial greenwits can be thrown out…. On stupid stuff on like the day you signed it. And all kinds of stuff that can throw it out for dumb reasons. This young man is smart and he’s correct …. You have to prove common law marriage…. 3:24
Common law marriages cannot be formed in Maryland. This means that regardless of a couple’s history or living situation, they cannot obtain legal rights from their relationship unless they enter some type of legal agreement, such as a cohabitation agreement, but a legal marriage cannot be created by a legal agreement.
The one saying she wouldn’t feel secure going into a relationship with someone who’s thinking in the back of his mind there may be a need for an escape route isn’t able to consider how things have been engineered to F men over in most circumstances. A man would be a fool to at least not consider the possibility. But she’ll surely find someone at some point who is open to a possible (~50%) chance of eventually being screwed over in court.
To enter into a common-law marriage, a couple generally has to satisfy these requirements: be eligible to be married and cohabitate in one of the places that recognize common-law marriage, intend to be married and hold themselves out in public as a married couple. In other words, a couple who lives together for a day, a week, a year ā states don’t have a time requirement ā agrees to be married and tells family and friends they are.
What isn’t really spoken about is that the courts heavily benefit women in divorce. Courts do disregard prenuptial agreements regularly if the commissioner feels that it is biased. If there was some ceremony that represents a “marriage”, the courts will see this as marriage under common law. Of course, if children are involved in a dissolution, then the guy is pretty much screwed.
Wisconsin does not recognize common law marriage, or cohabitation relationships, to be a legally binding marriage. If domestic partners or unmarried couples end their relationship, they’re NOT entitled to the same rights as a married couple in regards to marital property, real estate, or custody and placement unless there is a cohabitation agreement in place. I love living in Wisconsin lol
All these states have common law of some type. Also a relationship could be considered common law marriage in is little as 1 yr for some places. Be careful guys. Make sure to look up palimony Alabama Colorado District of Columbia Georgia (if the relationship began prior to 1/1/97) Idaho (if the relationship began prior 1/1/96) Iowa Kansas Montana New Hampshire (inheritance only) Ohio (if the relationship began prior 10/10/91) Oklahoma (Conflicting laws, discuss with a family law attorney) Pennsylvania (if the relationship began prior 1/1/05) Rhode Island South Carolina Texas Utah
The one brunette is seriously ignorant. There are only 8 states that have common law statues: Colorado, Iowa, Kansas, Montana, New Hampshire, South Carolina, Texas, and Utah. All a man has to do is move out for just a few days, then move back in and it resets the count for ‘common law marriage’. The concept of common law became unpopular and started being phased out in most states in the 1990s
Question. 20 year old here. I m confused: My ex girlfriend was with me for 6 years (3 years friendship, 3 years relationship). We had more of a platonic relationship where we didn’t even kiss, hugged or had sex, reason being that I come from a conservative family in India. Doing such romantic acts before marriage is considered as impure in our community. We both wanted to marry each other and that’s for sure. The thing is, we fought one time and she started hanging out with this 22 year old who in actuality was a punk, good-for-nothing loafer. The punk said he would teach my girlfriend to kiss as she too was attracted towards him. She didn’t feel quite right with him as he was being too touchy and inappropriate. We broke up last year but again in November she texted me and said she missed me. We still talk, but 2 days ago, she said that I m less understanding than the punk. I m confused by this woman. Also- She’s materialistic, egotistic, lives in fantasy, short-tempered and confused. What should I do? Should I keep on talking to her? Or leave immediately? Pls help me 🙏.
1). Be aware that any divorce court judge can void out any prenup ever drawn up by any attorney. The judge can void out the prenup for any reason he or she decides to dream up. 2). Men make the assumption that sex will remain as good and as frequent throughout the marriage as it was before the marriage. WRONG. Women provide sex as a way to get men to marry them, then after the marriage there’s no further reason to be a sexual partner, so they will continually cut back the sex until there’s no more sex at all. Married men get f*cked without getting laid. And she’s just sitting in a living room chair, smiling all the time. Any man thinking about marriage must therefore decide on marriage while assuming there will be no sex, and make the decision based on other factors. Any man thinking about marriage needs to talk to some married men to compare notes. Most married men will tell you there IS NO SEX after marriage.
While I agree with what the man is talking about.. Marriage isnt a “made-up idea”. What is best or correct to say is… Currently modern marriage isn’t what marriage was originally intended for. Marriage Was a duty for both men and women. Its one sided with the man carrying the majority of the responsibility and blame. As well as the financial burden post marriage. Divorce, rather No fault divorce is made up. Also the fact he didn’t know about common law is telling.
What makes marriage non-beneficial to men is the divorce laws that women take full advantage of that allows them to discontinue the benefits that men once got from marriage, while at the same time forcing the man to provide the benefits that women receive from marriage. Let me carefully explain. Before marriage when they are dating, a woman will give a man all the sex, home cooked meals, compliance & peace that he desires. But once they get married, she stops these things, effectively ending the benefits that a man traditionally received from his wife. Now, because of the divorce laws, he can’t just simply divorce her & find himself another woman. The laws are set up where a woman will automatically receive the majority of the assets that they have between them. It can even be a situation where she committed adultery while he was totally faithful, but will still be awarded the majority of the assets. The laws basically creates a situation that potentially entraps men while giving the woman no incentive to put forth the effort to please her man & keep him happy.
The lady has no idea about common law. A couple living together are not common law unless they declare to people they are married by declaration. In public they say they are husband and wife by reputation. Also, if they file joint income taxes and purchase assets jointly. Basically people can live together and have a relationship as long as they do not do the aforementioned.
I told my 19 year old son To look for a wife outside the USA. My two girls will have to marry early like 22 or 23 And they are going to be like me, traditional woman with a twist They are going to have careers instead of stay at home mom like me When my husband died all the sudden realized I should Had a career. But, they will clean, cook, take care of kids And put husband their husband first
Girl in the brown jacket is wrong. Most US states have done away with common law marriage. Courts often toss out prenups and they need to be presented, agreed to, and signed in a very particular way to hold up in court. Even then, they may not be recognized. The 3rd girl’s answer is hilarious. Marriage is about trust, so she needs the state enforced contract for that trust threshold to be met.
There are actually only 8 states, plus DC that recognizes common-law relationships. That one broad is way off base. iirc the states are Colorado, iowa, oklahoma, RI, Montana, Kansas and texas. Utah and New Hampshire have very limited common law recognition. There are a few states like California and Minnesota that have defacto relationship laws that are even more subversive, but most states do not recognize common law. Guard your shit boys
Huh. 5 seconds on the interne to see she doesn’t know what she is talking about: “Many people (mistakenly) believe that if you’ve lived with someone for long enough, then you’re automatically considered married.\r When in fact, that’s not the case in most states. The majority of states require a formal marriage license to be recognized as a valid marriage.” most of the states that recognize common law marriage do so under varying standards but typically they include the intent to get married, i.e. you are engaged AND then you cohabitate. Just living together is not common law marriage. You may also need to take on the duties of a married couple, live like you are married / represent yourself as a married couple, or literally tell the world that you are married, etc.
Also…that girl not willing to stay with a guy because he doesn’t want the government involved she claims is him looking out for his intrest if it fails. Like he’s going into the marriage thinking it’s gonna fail. Tables turned honey…..you don’t wanna stay with him if YOU….YOU….YOU….don’t get YOUR insurance if it fails that HE HE HE will have to take care of you in some way. A marriage with the government is nothing more than a cash grab and an insurance policy for a women.
Host needs to do his research before opening a discussion like this. Speaking as an attorney, the lady is correct regarding the law. Especially when CHILDREN are involved and/or there is an accumulation of property and assets. There is a TEST the Courts apply to determine if the living arrangement is a marriage. Sleeping together is one. Living together is another. Having joint accounts (bank accounts, utilities, etc.) is another. People perceiving you as a couple is another. Being together for more than 3 months. Etc. etc. The Court will then recognize the living arrangement as a “common law marriage” and requires a Divorce Petition be filed. This is complicated even further in Community Property States. And even worse in States which have ALIMONY. So thinking you can just live together without getting married is a solution is INCORRECT, STUPID, and IGNORANT. I can assure you a woman WILL find a way to collect money from the man. And women will not hesitate to use the Courts and blame the man as to why they are not married. In fact, women will use the argument that the man was doing it to avoid financial obligations. BOOM! The Courts and a Jury will side with the woman. And the man thinking he was being smart is SCREWED.
Kate(Green top) doesn’t like the prenup as its a off ramp for the man, so wouldn’t go forward. Yet without one and things don’t work, she has the off ramps with half of stuff and him paying for alimony and/or child support if kids. High stable guys need a prenup. Unless if with a high stable woman IMO both walk away ok. I’m sure a high stable woman would want a prenup for a lower status guy…but such situation are very, very rare.
That lady is totally wrong about common-law marriage. Common-Law Marriage is only allowed in a few states (less than a dozen). There is no such thing as a common-law divorce. When you split up, the only thing she is entitled to is anything her name has been added to… ie car deed, house deed, etc. If her name isn’t on it, she gets nothing.
All you have to do is ask the million dollar question? I have asked this many times and 99.9% is always the same answer. ” If the Laws were reversed and stated if couples divorced that the Men will majority receive custody and if the woman works a pretty good job that she would have to pay him, would you still get married? You already know the answer. Stay Single Fellas! 😂😂😂😂
People forgetting that marriage itself is like a prenup before God but just without papers. Both man and woman promise to be together in happiness and sorrow till the last breath. Problem comes when to disobey or cheat. So to protect yourself from huge loses just sign it so both parties can benefit and agree on the terms. Only sign when both agree on the terms stated. Else modify
