Can You Create A Prenup After Marriage?

A prenuptial agreement is a legal document between engaged couples that dictates the division of assets and debts in case of marriage dissolution or death. It is typically accepted as valid upon entering a marriage, provided both spouses have adequate legal representation. However, a postnuptial agreement, also known as a post-marital agreement or postnup, can be created after marriage and achieve the same objectives as a prenup.

A postnuptial agreement can be used to protect children from another marriage and their inheritance by setting up a trust. While it is not as frequently discussed as prenuptial agreements, there is still an option for those who want to protect their assets and property. Postnuptial agreements are made after the wedding but are scrutinized by the court.

In some cases, it is possible to obtain a postnuptial agreement if you have not obtained a prenuptial agreement. However, it is less common and may come up because people realize they should have gotten one before. In North Carolina, where the division of assets is not allowed, postnuptial agreements offer a viable solution.

In summary, a prenuptial agreement is a legal document between engaged couples that determines how property will be owned and managed during marriage. Postnuptial agreements, on the other hand, are made after the wedding and are enforceable, although divorce courts may not always agree with the document entirely.

A prenup can protect your finances if you divorce because of infidelity. Prenups aren’t just stuffy or offensive anymore. They are now widely seen as useful financial management tools. Is it a red flag if a guy wants a prenup?

About 40% of marriages end in divorce. That’s scary! So, whether your boyfriend saved $50,000 or inherited $50 million, I understand his impulse. Asking to protect his assets and divide those you create together is not a sign he thinks your relationship is doomed. Buying fire insurance is not proof he’s an arsonist. Stuff happens. I’m not a fan of prenups for people without big assets or liabilities. (I’m looking at you, medical school debt!) Life is unpredictable. One of you may get a great job. Or having kids may make a spouse earn less. These things may not happen for years. Complex prenups that divide assets or cap support payments before there’s a track record of earnings are silly and often unfair to the poorer spouse. Ask your boyfriend what he’s worried about, then hire a lawyer to talk it out. Don’t be pressured into a prenup. You can’t marry the guy if you can’t agree on what’s fair.

Protecting Our Loved Ones. My brother is in jail because of drugs and a moving vehicle. It’s a mess! Our mother recently moved into an assisted-living facility. She’s just getting settled. She also asked about my brother, who normally visits her. He wants me to help arrange a phone call with her, but I don’t want to unless he promises not to mention his legal troubles. It would upset her. My brother won’t make that promise. What should I do?

Is a postnup as good as a prenup?

A prenup is more likely to be enforced than a postnup if one of the signers tries to challenge it after the marriage ends. Divorce courts assume that people who sign a prenup before marriage are less likely to be coerced. A prenup forces couples to discuss money before marriage. This can help avoid later misunderstandings. A prenup can ease concerns that one partner is entering the union for financial gain. Prenups can also make sure that children from a previous marriage are taken care of. It can save money on divorce attorney fees if it comes to that.

What is stronger than a prenup?

Can you protect your assets without a prenup? The best way to protect assets is through an irrevocable trust. This keeps your assets separate from your marital estate, making it harder to challenge in court.

Summary: A prenuptial agreement doesn’t guarantee asset protection. Instead, set up an irrevocable trust to protect your assets from divorce claims. This method gives those with significant assets more control and peace of mind. You probably heard it’s smart to get a prenup before getting married. Is it bad if he wants a prenup?

Know why. Breathe. Don’t assume your partner wants a prenup. Have an open and honest conversation. Prenuptial agreements don’t mean your partner doubts your relationship. They’re often a way to protect both parties in case of an unexpected event. You get car insurance because things happen. You don’t buy car insurance because you think you’re a bad driver. Prenups are the same. Some people want a prenup to protect their assets, future inheritances, financial responsibilities, debt, and how assets would be divided in case of divorce. It’s important to be open-minded and understand that your partner may have good reasons for wanting a prenup.

Think about the practical side. It’s normal to feel different emotions when you think about a prenup. You might feel hurt, offended, or betrayed. But you have to think about the practical side of things.

  • Good question, I”m afraid I can’t really answer it, since I don’t know your state and the income difference you mention is important but do you make $40,000 vs her $0 per year? or do you make $240000 vs. her $200000? It’s these little details that can really make the difference. Sorry, I wish I could have been more helpful.

  • very informative article. it cleared a lot up for me going into a marriage at 24 years old. my fiance and I have annual incomes that differ by probably only 40K a year and i currently own about 22K worth of property more than her. At first i was thinking a prenup might be a good idea since i will be paying about 65% of our future bills and mortgage but now it seems that i would not lose 50% in the event of a divorce.. – is this true?
