Getting engaged while going through a divorce is not illegal, but it may affect the outcome and your spouse’s reaction. While engagement does not have any legal implications, it can impact divorce time, stress, cost, custody, visitation, and other real-life consequences.
Going through a divorce means you likely haven’t dated someone new in a while, which can be scary. However, engagement affects your legal rights, such as property, finances, and immigration.
The short answer is yes, but the long answer is more complicated. The actual act of dating while your divorce is pending will not affect the outcome of a divorce. The court distinguishes between pre- and post-separation relationships, but every divorce is different and dating can potentially have adverse effects throughout the process.
Going through a divorce can be stressful and lonely, so if you’ve found someone you’d like to get to know better, it might be okay to go out on a date while your divorce is pending or even while you’re separated before filing. Any fault grounds for divorce do not look good in the light of moral fitness, and all decisions a judge makes in a child custody case will be for the best interest of the child, not the parent.
When you’re going through a divorce, everyone in your life gets a front-row seat to the drama, including your friends and family. While they can be great pillars of moral support, they may also have their own opinions about how you should be handling things, including new relationships.
In summary, getting engaged while going through a divorce has no legal consequences but may affect the outcome and your spouse’s reaction. It’s important to be aware of the potential negative effects of dating during a divorce and to be patient with your friends and family.

📹 Are You Dating A Man Going Through A Divorce?
Are You Dating A Man Going Through A Divorce? You can’t help who you fall in love with. This is true – but that doesn’t mean it’s …
Evan, I am going through this right now. Met an amazing guy and we are like perfect for each other. I knew the risk and of course today he told me he is not emotionally ready to take our relationship further. It sucks being at the right place at the wrong time. And the most annoying thing is that I bet that within a couple of months he will be with someone else.
This is good advice I agree. The last 2 guys I dated: one was separated/going through a divorce, the way he described her was she was a horrible person, yet he ended up going through a divorce with her, dinked me around twice (luckily it was short lived), THEN they ended up getting remarried and had another baby together. The guy after him WAS divorced for more than a year and also ended up going back to his wife, but I am not sure what happened after that situation. This was all between 2015 – 2017. I only use logic now and no emotion. Emotion gets you in trouble.
Im married, and been separated for more than 12 years. Im filing for divorce this year,. The Kicker, I dated someone 6 months ago and fell deeply in love with this woman. I had to break up with her because of the imbalance in the relationship, Im in love with her and ready to move forward after my divorce and shes not ready for a relationship. Either way, I realize I can only solve one problem at a time, and the divorce must come first.
I’m dating a man who’s been divorced for over 7 yrs. ‘Going through & ‘is, are almost the same thing. One thing people have to keep in mind with this type of situation, your bf’s ex/family doesn’t ever go away. Women getting involved in this type of partnership have to possess, a strong back bone & thick skin. (Sometimes you will feel left out, no matter your standards) Now, with that said, I as a woman who has never been married/no kids, have been engaged once & have had many long term relationships that all have spanned over 2-3 years each..eventhough never walked down the aisle, I consider all my relationships almost like marriage with the heart, mind and soul that went into it all. Both parties have baggage., a past, wants and needs. The priceless advice I could give when dating is, do not have ‘Expecations. Preconceived notions of how things should be is overshooting the ball. Have Self Confidence, focus on you & be filled with Self Love. Everything else that is suppose to.happen will fall in line. Your destiny will come find you.
Yes, clichés are clichés because they are often true. However, relationships are as individual as the people (and circumstances) involved. And I’ve seen many men interested in something serious relatively quickly after separated and after divorced. My Dad was one of those men. He was in his 40s, no minor children (I was an adult) and he was not a typical guy who wanted to play the field. He was under no illusion that he was some twenty or thirty year old or that life and dating was some candy store or party. He liked having a partner and was married again 2.5 years after my Mom and he divorced. Age and circumstances matters too. Without minor children or child-support, its a different ballgame. Also in terms of timing and especially after COVID, courts were backed up so much that some divorces took 2-3 years to be final (or more depending on many factors like the agreeableness between the spouses). Are we really saying someone shouldn’t date who maybe hasn’t lived with their soon to be ex for a few years or maybe even hasn’t laid eyes on their ex in that time?? Thats ridiculous. I’m old enough now to be aware of the red flags and clichés, but also to know that its ALL a crapshoot. You could also have as much success with a newly divorced person as you can picking up some long-time single person. Just because someone has been single for a long time doesn’t mean their mental health or anything else is any better. Humans want to categorize people and situations and put timeframes on everything, but again, its all a crapshoot – Especially where emotion is involved.
I’m the separated wife in this situation. My Husband of 16 years was all geared up to go on the market and enjoy the freedom to go with his massive weight loss. He started seeing someone before he officially moved out. From what I heard, him and this girl (10 years younger than him) we’re in peak infatuation mode. But then she got pregnant right away. Now my soon to be husband who shares teen children with me, is starting to realize he’s just jumped out of the pan into the fire. He sounds miserable now, having a kid with his rebound he barely knows. He was the one that left me but I realize he did me a favor. And now she’s about to see the real version of him that will stress and overwork to now pay double child support. The great guy she was having fun with is now a guy racked with guilt and extra responsibility he wasn’t ready to cope. It will most likely kill their relationship before it even gets a chance. But I hope for the new baby’s sake that can stay friendly.
As a guy going through a separation at this point, it’s very difficult to move on if I don’t believe I have any options, and long for a healthy relationship with a good fit for myself. That being said, what he is saying is true, and any woman I choose to date must be aware of the fact that I’m not likely to jump into the fairytale role of Prince charming, at least anytime soon. I’m looking for dating casually for the time being, and want to vet the crap out of a woman before I get serious, once the divorce is finalized. Honestly, I don’t know how many women would be happy putting up with that sort of situation, and most who would wouldn’t pass the vetting process once the divorce is final, so the more likely scenario is that I will be having fun with one woman, and settling down with another. If the guy’s not divorced yet, you will either be the first girlfriend, or the second ex-wife, but odds are you will not be growing old with him by your side.
I’m going through this. Till 4 months things were okay..but 5th month my anxities set in due to which we started having regular fights as I was getting too anxious as to where is this heading. Been 20 days he hasn’t called.. he is taking medicines for depression too. I wonder why did I even get into this in the first place. I’m so wrong.. and now I’m unable to move on. I’m in so much of pain emotionally. So in my case, “B” happened
Thanks for the article! Im 27 and my bf 37 . He is still on the process of getting divorced. He has a kid that comes to his place alternative weekends. I do love him but he seems senseless when I open my feelings to him or when I want explanations about his past . This recent facts make me want to leave but I love him and wanna try as much as I can . Thanks community!
I’ve been seeing a man for 1 1/2 years. His divorce is pending. I felt something was wrong. I found out He’s been seeing his high school sweetheart for the past year. He even bought her a ring, looking at houses together. Going on trips with him. I’ve been paying his bills and giving him money for his trips just to find out that she’s been traveling with him. It doesn’t show any remorse. He told me I couldn’t see his kids til after the divorce papers were signed. But this other girl has been spending time with his kids. It’s been such a lie. I’m such a fool. He doesn’t even feel remorseful.
no no territory for me. I guess i’m still young enough to find someone who’s never been married because no matter how good someone looks, i will never want to be with a divorced or separated man. It’s an immediate turn-off 😀 If i’ve never been engaged or married, i want someone who wants to experience those things with me for the first time and for the rest of our lives.
You don’t have to date with marriage as a goal. When I go back to dating I want everything but one thing, get married again, ever. You can be as happy together unmarried, as when married. Being married is just a ring and a status in some computer system, it doesn’t define you as an individual, or as a couple.
Hi I’m in a similar situation, we have been together for 3 years and lived together for 2, he has been separated for 6 years and he couldn’t get divorced… until now that he is back in the states, he has been there for 3 months now… we continue to talk everyday and we still hold the relationship, I gave him an ultimatum of waiting until July for him to divorce and us to get engaged, of course I feel I’m forcing the situation but I do love him, and I think he loves me too, but idk if he will ever get divorced and I do feel I’m wasting my time and I made a terrible mistake of investing soo much time…
I was dating a separate man for a few weeks and he was moving fast wanting to meet family ect, but as people told me it was best to leave him alone I decided to tell him it’s not a good idea to see him but left the door open. I never went as far as sleeping with him I told him I liked him and he said he liked me. Left on friendly terms fast forward a few months (he’s still divorcing) I see he’s seeing another girl! They have met each other’s family and everything. I’m a bit gutted as I like the guy but idk have I saved myself from being the rebound or did he just not like me that much. He doesn’t know I know about other girl
I’m in this situation married man separated no plans to go back to the wife, share no kids, she won’t agree to divorced. He’s telling me he wants a long term relationship with me but I see no urgency to get this divorce I pray I’m not wasting my time. I told him no divorce papers we can never be sexual. We talked 3 months he told me about the wife left a year later I gave him another chance to get this divorce
I’m also a divorced girl, I’m dating a man for one year now, And I came to know that he’s married before 5months now and he had a 9 months daughter, too., He said he wanted to divorce already, but due to her pregnancy he stopped, till she gave birth and after that, his family…. But what makes me curious that he talk to me all the day, all the night, even When I looked back to our messages at the day of her daughter birth, we were talking all day, and in article calls too, I’m surprised, I decided to break up, but he didn’t want, he always stay by me, even when I really decide to leave, now he’s divorced but what makes me feel damn is his wife, she’s still keeping her name in her Facebook and Instagram, qnd everywhere, what should I do in such situation! I also love him a lot
