After marriage, a woman acquires the domicile of her husband if she had not the same domicile before and her domicile during the marriage follows that of her husband. However, if the husband and wife are separated by the order of a competent court or if the husband is undergoing a sentence of transportation, the wife becomes capable of acquiring an independent domicile.

Domicile is important wording when regarding divorce cases with stipulations of residency. Courts typically define “domicile” as the residence you consider to be your permanent home and to where, anytime youre absent (for vacation or extended work). Once domiciled in a state, your domicile continues there until a new one is established. To establish a new domicile, you must abandon your old domicile, have no intent to return to the old domicile, establish physical presence in a new state, and have the intent to make the new one.

In some states, such as New York law, spouses who are legally or de facto separated may be acknowledged as occupying separate domiciles. Persons married to US citizens are considered “immediate relatives” in the immigration process and can apply immediately for LPR status. The spouse who must accept the burden of her husband’s domicile is the husband, not being required to accept the wife’s domicile.

The wide and general principle of law throughout the Empire is that the domicile of the wife is that of her husband and that she-cannot acquire a domicile apart from her husband. If desirous of instituting proceedings for divorce, do so in the tribunals of her husband’s domicile. Although a domicile may change from time to time, a person has only one domicile or residence at any point in their life, no matter what their circumstances.
