Does Islam Support Child Brides?

Islam allows child marriage, where parents of Muslim children are allowed by Allah to convene their minor child’s wedding contract (kitab al nikah) even when the latter hasn’t attained puberty. However, research has found that child marriages have long-term negative consequences for child brides and grooms. In many ancient and medieval societies, it was common for girls to be betrothed at or even before the age of puberty.

The Quran supports marrying prepubescent girls, as jurists agreed that a father could contract his child in marriage at any age, while the family was to hand over the daughter to her husband for consummation when she could physically tolerate intercourse without financial support. Child marriage is linked to poor health, curtailed education, violence, and lawlessness, which threatens international development, prosperity, and stability.

The world is home to 650 million child brides, including currently married girls and women who were first married in childhood. Of those, 40 million (equivalent to 6%) child brides are in the MENA region, with the highest numbers being in Sudan and Yemen. Every year, 700,000 girls are forced into child marriage in the MENA region.

Islam strongly prohibits sex outside of marriage, as it is the beginning of legal sexual relations and reproductive roles. Early marriage has no place in Islam because it is unacceptable and violates the Shariah. Marriage after puberty requires comprehensive maturity and sound adult judgment, given that it is a legal contract.

In many Muslim countries, legal reform has taken place to ban the practice of child marriage, but child marriage is considered haram or forbidden by Islam.

What does Islam say about child brides?

Many Muslims say child marriage is wrong because Islam says men and women should choose their partners, and children can’t do that. Islamic law allows marriage when a girl reaches puberty.

International laws say that children can’t get married. They say that 18 is the age of adulthood. These laws say that children and teenagers are not mature enough to make marriage choices. Marrying too young can cause long-lasting emotional, physical, and psychological harm. Child marriage also stops girls from going to school and getting jobs, which makes poor communities even poorer. They say delaying marriage and investing in girls’ futures can benefit communities. Child marriage happens everywhere. In developing countries, one in three girls is married before 18, and one in nine before 15. Analysts say that 142 million girls will marry before adulthood within this decade if current trends continue.

The practice is still happening in many places around the world. The highest rates are in South Asia and West and Central Africa, where two out of five girls are married as children. India has the most child marriages, with about 40% of all child marriages taking place there.

Is it Haram to force your daughter to marry in Islam?

Islam treats men and women equally when it comes to choosing a spouse. It doesn’t give parents the right to force them to marry. Parents can give advice and guidance when it comes to marriage, but they cannot force their children to marry someone they do not want to marry. The final say is with the children. Marriage is a private matter. Parents cannot force their daughter to marry someone she doesn’t want to. This is oppression and a transgression on the rights of others. In Islam, women can accept or reject marriage proposals. Her father or legal guardian can’t force her to marry someone she doesn’t want. Marriage should be based on love and mercy, not compulsion. Many legal texts from our tradition show that this is a firm ruling. Events show how the Prophet dealt with a woman and her guardian. He challenged the norms of the time that oppressed women. He said that a woman has the right to choose her husband and that marriages made against her will are not valid. This broke with Arab traditions. This was a test of the believers’ hearts to be satisfied with the pure law that honored women and respected their will and choice, while freeing themselves of all the norms that did not value women. The Prophet said that women have the right to:A widow must be consulted before marriage, and a virgin must give consent. They asked, “How does she consent?” He said, “By staying silent.”
