honestly, if the woman or her family have issues with signing such documents, its a pretty clear indication of how they think and what their motives were for the marriage. and if later on they say that “we will sign the documents. please dont cancel the wedding. we will agree to everything. lets not get emotional here.” do not let them sign the documents, because if disputes arise in the future, this particular document will definitely be cancelled as their lawyers will argue the point that the document was signed under coercion as they stated that the marriage will not happen if the documents are not signed. put these documents infront of your future wife and future in laws and their reaction will tell you everything you need to know about the marriage.

The fact the era of failing marriages that we live in, it does becomes sensible & rational to go with notary declaration as recommended by you. But my question being from philosophical point of view, aren’t we creating an air of mistrust & manifesting foundation of marriages on it right from the beginning where marriages are failing predominantly for the usual reasons (dowry, job, etc) but also due other major incompatibility issues (with present generation having lower threshold & no compromise attitude) & implementing the recommended solution by you seems to be like a temporary relief from heartburning of going through litigation battle against the spouse but at first instance doesn’t prevent or at least delay the time marriages failing (addressing the root cause?)

Please Explain : 1) The evidentiary value of this affidavit in the maintenance proceeding. 2) What will happen if the wife comes to court and says that she signed this affidavit under coercion or was blackmailed or threatened to sign in. Also, this affidavit is not a registered document and has no binding value then how can you say that the court will be able to pass any order based on a document the authenticity of which is not known and it has also had persuasive value?
I have few questions regarding providing maintenance in case of divorce: 1. If divorce is mutual? 2. If a wife is earning ? 3. If a wife is earning more than the husband? Does the maintenance have to be paid by the husband in these scenarios? Is there any provision where the husband can seek maintenance?
Can the prenuptial agreement be challenged as well, in ways wife stating that she was coerced into agreeing to the terms and now are being used against her? If yes, then how can husbands prove this? Will there be like witnesses to this agreement or any other way to prove the bona fideness of the agreement.
My no. 2 question is – there are some good laws through which if someone wife filed a false case. Then she will be put in jail. Example – IPC 211, IPC 182, CRPC 340. And there is another way to prove someones innocence is that husband can file crpc 91( through which he can also claim proofs whatever false cases has been registered against him) and crpc 97 and section 24 . I mean i am talking about counter cases.
the FIR in the cases is just a cut paste job. secondly pre nup is useless as woman can claim she was harassed after marriage and also these agreements were signed under duress.. the point of the case is just to harass you mentally by running around courts. the best protection is to keep your valuables safe, as anything taken by her you will not be able to claim. if she gets nothing for 2-3 years she will definitely agree for divorce on your terms. i have seen in some case wife has taken the house under her name and then demanding additional alimony.

I’ll marry a woman who is in the same professional field as me but I would never divorce probably like my dad even if she swears me out. I’ll have to stay for my kids. I can live without love tbh. I think prenups arr important for women too. Many a times the boy’s family say we don’t have a problem with a working Lady. And later they force her to leave her job. There have been many cases where men and women are married without dowry and after a few years when the man physically abuses the woman and the parents intervene, the man and his family declare that no dowry was paid to them. So, if the woman signs an affidavit declaring that she paid no dowry and then later get abused for dowry, don’t you think the law will tip towards the man’s favour when she claims divorce on the grounds of physical abuse? Prenuptial agreements are good for both not just men’s safe guarding… there are many cases women face those have no proof available … sometimes asking for dowry is also not possible to prove as they call it gift now or lavish weddings … either ways its a cultural issue and its important to have fair prenup discussed not one where a woman is stripped off all her rights… women are in most cases forced at wedding time for various agreements spoken and unspoken … I am in for fair but only if it truly fair not if an Indian man asks for dowry, ask a woman to not work, dictate her life, use her money to run d household and even buy properties in many cases and then say you don’t want her to excise her rights either – not fair.

What about women feeling suicidal n suffocated in indian homes?? What about lifelong trauma they live with? Men’s assets, jewellery, alimony is everything you can think about?? I’m not a feminist but you have to acknowledge that there are victims living a very difficult life in our society.. If given an option, would you like to come (reincarnate) to Indian society as a woman (of backward underdeveloped strata) in next life?? Religious views kept aside but imagine being a girl in this society.. do you think about all women are after money n misuse law? Do you think all men are innocent?? Being born as a woman in India is equivalent to a disability where so many restrictions are put on you since day 1… try to look at things from different angels.. you are not educating people, you’re training your prospective clients so that they can come up to advocate with a strong case and your work becomes easy..this further reduces the chances of justice if you only educate people about loopholes of the system.. this way you stand in the same boat, no different between you n women who misuse law.

Supreme court should make a law to own a body cam with audio for everyone and make it compulsory so that each and every individual can be free of any false charges. Everything is recorded . Plus supreme court must make it compulsory to provide free body cams or any cam that record audio and article bcos all legal people only believe when they have proof right. These legal people need proof but what about emotional hurts, mental cruelty who sees that .
