What Does Being Separated In A Marriage Mean?

Separation is a legally defined term that refers to an arrangement where a married couple is living apart but still legally married. It can be either trial, permanent, or legal, and can be an initial step in the divorce process. There are three basic types of separation: trial, permanent, and legal.

A separation means that you and your spouse are living apart but are still legally married. Signs of reconciliation include improved communication, decreased conflict, openness to making adjustments, and willingness to engage in couples therapy if warranted. Legal separation is an arrangement where a married couple lives apart but remains legally married. It can be mutually agreed upon or ordered by judicial decree. The rights of legally separated parties may differ depending on the form of separation and the laws in the jurisdiction where the parties are domiciled.

In some cases, a legal separation is meant to be a stopgap measure until a better decision about the marriage is made. It is best for the spouses to agree to the terms and set some rules while being separated. Prioritizing your relationship and respecting your partner are essential steps in aiming for reconciliation after a separation.

Marital separation occurs when two people who have been living together in a marriage decide not to live together any more. It is possible to be separated and live separate lives legally, often when the couple is contemplating divorce but not completely sure they want that.

  • That’s why if you are separated, DONT get into another relationship if you are not divorced because at anytime a spouse wants to pull their “wife or husband card” they will! I’m so tired of married people going living their lives with other people and then when one spouse wants to try again because of whatever reason, the other spouse is left with guilt and drops that other person to go back to their spouse just because of papers. STAY AWAY FROM THESE PEOPLE WHK SEPARATE AND GET BACK FOR SELFISH REASONS

  • Thanks for the advice. I’m currently going through a very painful separation. My wife of 13 years, together for 17, suddenly separated from me in July. Said she had pent up resentment towards me, but the things she mentioned were incidental and I know those things she mentioned are things that we can work on and move past. I don’t understand why she is giving up so easily. I’m trying to make it work but we are in the middle of finalizing separation papers and she’s getting impatient with me. Saying if it deviates from what she originally gave me she will take me to court. The messed up part is, she is still acting normal around me like there isn’t this big problem. Allows me to cook for her, do things for her, but when it comes to me and inviting me to be a part of things in her life, she cuts me out. It’s just strange and cold. I don’t know how to act or feel but I do know I’m hurting and I want her to come back to me so we can work on things. 😞

  • I’m Happily divorced for 8yrs. My analogy of marriage or reconciling. Marriage is like drinking a slurpee. 1st couple of drinks is like ‘Boy’ this is really good, I’m glad I did this, then you keep drinking and drinking… it goes right to your head… oww, oww, ooww 😖! The hell I’m thinking! Someone kill me please!!!

  • Hi so me and my wife separated a month ago and she moved out, things got worse quickly and now my marriage therapist told us to cut contact for atleast a month to self reflect and have a “cooling off period”. Do you suggest this is a good idea because in your article you said to keep contact. Originally, we had a plan when she moved out and it changed quickly and now she wants a divorce.

  • An excellent article on separation and a lot to reflect here. My spouse and I are going through a separation phase since a year now (11 months). I have a small kid who is just 3.4 years old. My spouse has always been very miserly in his spending. However, I am not so. We both are highly educated people though. I am non working at present. I am trying my best to make him understand we have a small son to raise but he seems to just show superficial love for the child and none for me. I am trying so hard since over a year. What do I do? We both have on-going Court cases against each other in the same light. He has not paid a single penny for my son or me in the last 1 year. Pls guide me.
