Deuteronomy 7:2-5 teaches the Israelites not to marry anyone who did not follow the true God. God does not prohibit marriage between a Christian of one race and a Christian of a different race.

Deuteronomy 24:1–4 discusses the Mosaic Law related to divorce in ancient Israel. In order for a divorce to be granted, there had to be a problem related to the widow’s widow’s husband’s brother. A newly married man must not be sent to war or be pressed into any duty. For one year, he must stay at home and bring joy to the wife he has married.

Deuteronomy 17:14-17 establishes several principles related to divorce and remarriage. God’s ideal was a marriage that united two people as one “as long as they both should live.” Today, God’s desire is for marriages to be permanent and sources of joy and fulfillment to both parties.

Marrying a captive woman is forbidden, and if a man finds a beautiful woman among the captives, he may take her as his wife. The result of the marriage will be a hated wife and a firstborn son of her.

In Deuteronomy 22:28-29, a man must pay fifty shekels a of silver to marry a virgin who is not pledged to be married and rape her. He cannot divorce her as long as he lives.

Deuteronomy 22:22 warns against lying with another man’s wife, stating that they will both die. Marriage should be honored and kept undefiled, as God will judge sexually immoral and adulterers. Leviticus 20:10 states that a man who has recently married cannot be sent to war or have any other duty, and for one year, he can stay at home and bring happiness to his wife. A man must never marry his father’s wife, as it would disgrace his father. Divorce and remarriage are important, as they reveal the desire to bring happiness to each other. The first couple can remarry if both individuals remained unmarried since the divorce. Deuteronomy assumes that children will naturally ask questions about spiritual matters in their parents’ lives.

What does Deuteronomy 24:5 mean?

Moses said that newly married men were exempt from war for a year to establish their homes and make their wives happy. The law in v. 5 was to complement a previous law in which a man engaged to a woman was exempt from military duty (Deuteronomy 20:7). Moses talked about when a man takes a new wife (v. 5). This man shall not go out with the army like the engaged man. Going out with the army means the man might die. If he died in battle, he wouldn’t have any children. The newly married man was not allowed to go into combat so he could build a strong home and have children. He was also exempt from all duties. Such duties would take away his time at home. Jewish law during Jesus’ time allowed divorce for many reasons. Examples include not liking how a wife dresses, her age, or her ability to have children. The teachers of the law focused on whether a certificate had been filled out properly, not the reasons for the divorce. I bet they were also concerned with whether all the fees/favors were paid in advance. The Deuteronomy passage shows that the law is there to protect marriage, not make divorce and remarriage easy. I’ve even had dreams of it happening; and not making this up, I’ve lived through them. I am now so confused. Now all I can do is pray for mercy.   • A friend told me that there is a verse Jeremiah 17 verse 13 where it says “Lord, you are the hope of Israel; all who forsake you will be put to shame.   • One interesting thing about the woman caught in adultery is also about the law that requires two witnesses against the condemned person. The teachers of the law and the Pharisees who, on the surface, care so much about the law, are by the end of the story gone from the scene. It is now just Jesus and the woman caught in adultery. Jesus has dismissed all the witnesses! So following that law requiring two witnesses, Jesus does not condemn her. But as was said in the podcast, Jesus lets her go but with the command not to sin any more.   • 51 minutes in : taking a woman as a wife is NOT always an act of thievery or oppression — even in times of war. Men and women need one another and filling the space of desolation with honor is not necessarily a bad thing. He would be cloaking her with his provision and protection, which she would ultimately still have need for even in the wake of her previous husband.

Jesus merely dismissed the case because there was no charge made… Had the charge been made, according to David’s view: she would have been stoned to death according to the law. According to modern understanding and preaching, it’s made out to be as though Jesus would never condone capital punishment, which is not true. Think about the thief on the cross… he had forgiveness, but he underwent the just punishment of the law.

  • It’s silly to say that she’s a passive victim. Assuming the man makes a good judgment, then she actually did something terrible. She initiated the divorce by doing the thing, and the man would be the passive victim. In real life, there’s rarely a passive victim and both parties do things that cause the divorce, but it is possible for one party to be solely to blame. If one party is solely to blame, then the other party would be the passive victim, could be the man or the woman. Your discomfort with the passage does not come from having a new testament mindset. It comes from a modern sentiment that women do no wrong.

  • You are being too easy on the Bible by saying it didn’t mean to create a gender differential. Genesis clearly states in Genesis 2:22: Then the rib which the Lord God had taken from man He made into a woman, and He brought her to the man. In Genesis 2:20 it states that he did the above because “there was not found a helper comparable to him.” In Genesis 3:12 Adam describes Eve as “the woman you gave to be with me.” In Genesis 3:16, God says to Eve, “Your desire shall be for your husband, And he shall rule over you.” So, as we can see, God did create a gender differential. One thing Christians miss because they don’t want to see it, I think is that God made woman “desire her husband.” This means sexual desire as well as other kinds of desire – protection, company, admiration etc.. Throughout the Old Testament, men are given credit for “begetting children.” God does not say the woman begat the children even though she is the one that lay on her back, was impregnated, grew large with child, bore the child in pain and then suckled the child at her breast. It’s always men who get credit for almost everything in the Bible. In Genesis 5:1,2 The Bible does say, “He made them in the likeness of God. He created them male and female, and blessed them and called them Mankind in the day they were created. So, here we see God being just as kind to women as men in that he made both of them in the likeness of God, blessed both of them, and called both of them Mankind. In Genesis 5:3 it goes on to say, “And Adam lived one hundred and thirty years, and begot a “son” in his own likeness, and named him Seth.

  • I’m a bit baffled as to why the prophets we’re completely left out of this discussion. Jeremiah, Ezekiel, and Isaiah all give very important context on how to correctly frame the deeper meaning of the discourse between Jesus and the Pharisees. The discussion here is so surface level and profane, it really makes me question what these guys are doing. Jeremiah chapter 3 and Ezekiel chapter 23 put the whole discussion of what Jesus and the Pharisees were debating into a completely different frame. There are so many questions that snap into sharp focus and actually make sense when one comes to understand that everything surrounding Jesus’ death and resurrection are directly related to the law regarding divorce and remarriage. That is why I am a bit disturbed that these guys didn’t give Jeremiah more than a passing mention. Jeremiah specifically refers to God giving Israel a letter of divorce for goodness sake. How much more relevant could you get to this topic? And yet it is utterly neglected here. One has to understand the history of Israel immediately following Solomon’s death and the ongoing dispute between Israel and Judah afterward. What did Jesus mean when He said that He came only for the LOST sheep of the tribe of Israel? Why did Jesus accuse the Pharisees of being Jews who are not Jews, bit of the Synagogue of Satan? Why did Jesus wait to come to Lazarus until three days after he was placed in the tomb? Once one begins to understand the law and the history of Israel following the great schism, then the words and actions of Jesus take on new significance.

  • If the reason/ground for divorce is adultery then it contradicts the law where the punishment of adultery is death penalty of the adulteress and the adulterer. Is the word pornea in ancient time ( in greek language) mean adultery? You won’t be able to divorce a woman who commits adultery because adultery is a sin punishable by death. Why give a certificate of divorce if the woman is going to die anyway?

  • I don’t see the death or surely die that God speaks of is the type of death that man has come to believe, which is of the body. How can we man have capital punishment (a term not in Scripture) when a top command from God is not to kill a man because God made man? Cain was not slain, but protected from such fate. Yet, he was cast out of earth and from the fruits thereof. This command is amplified or detailed after Noah and family left the Ark. Then again with Moses from God’s own finger. And with Jesus, if you hate a man, you have committed murder. So, God isn’t speaking about death to the body, which is His temple. God clearly says He gives life and takes away life. Life is of God. No man can take it away. I see the death God speaks of for a man in disobedience to Him is separation from God, which is like unto those of the seed of Satan. It’s a type of prison we enter in sin, which wages is death. This speaks to the spirit, not the carnal. Your thoughts.

What if it’s the unfaithful husband who discards and divorces his first wife, marries another, but then returns and remarries his first wife? Does God allow that or would he also be considered impure and detestable?

  • 45 minutes. I think you have it incorrect that he rapes her. Looking as your Deuteronomy 21:14, reference and compare it to many others, including 2 Samuel 13:14 we have different Hebrew words. “ana’ is not rape, but “ana” combined with “saqah” is rape. He actually did humble her by doing the many things to her before she by trickery or truth drcides to marry him instead of being a slave. It seemed better to her to marry him than be a slave. But she did not join herself to Israel like Ruth and chise to remain her previos culture at heart thus he put her away the a “gat”, divorce papers.

No, it hasn’t. Therefore the Law(Torah) is NOT done away. The only part of the Law that is not done is the animal sacrifices, because Yeshua(Jesus) replaced the animal sacrifices.   • The part that talks about the wife and her second husband and the reason she can’t go back to her first because she had become impure is this: During intimacy between husband and wife it is the woman body that absorbs her husband not the man, because of this if her first husband has her back her body is impure because her body is still carrying her husband fluids. It was Bishop TD Jakes or another minister like him that I learnt this from. And the part that you said shortly after this you said divorce has ‘developed’ – it has not developed but been modified or changed

  • You are implying (in one of several occasions) that the Loving God of all and, that is true and just would allow a man to “take” a woman just because his heart was hardened ?   • I don’t think you guys have any practical knowledge in marriage and divorce. While this podcast/recording of audio is somewhat interesting and in a way entertaining, it is not taking this topic as seriously and realistically. So much time and emphasis spent on “dignity of women and children” while ignoring the reality of this real world – have you ever had to deal with marriages gone wrong and spoken to actual re-married/re-constructed families? The topics handled here are immensely heavier and perhaps beyond your scope of expertise. Please focus your attention and talent into what you’ve been called for – the visual presentation of the scripture. I liked the way you explained the concepts through visual presentations many times over. Verbal pseudo-debates of these types are, in many ways, flawed.

  • The Bible’s stories are for spiritual purposes. We know from Paul’s NT writings that there is a hierarchy in which man is the head of his household, as Christ is the head of the Church. So, we can see that woman represents a faithful or prostituted wife…So to say that a wife is impure after divorced, remarried and not available to the first husband is symbolic, even as it is psychological for both parties. And it is consistent and demonstrable of God’s message. After all the Bible and this existence is about a greater truth and reality, the biggest picture of all; from a benevolent Creator who is giving us everything…I’m not sure if you two are being sympathetic to the audience, or if you are a little soft about the topic. But even as the Church is soft on the full teaching of Paul about women’s role in total, we don’t lean on our own understanding but we follow the words of our Savior (as given thru Paul; even as Paul was building on his knowledge of the OT)
