The Supreme Court recently observed that when a man and a woman have continuously cohabited for a long time, there is a presumption of marriage. This presumption should be limited to situations where there is a valid basis for presuming a marriage rather than being used to avoid it. The concept of presumption of marriage is provided under S.160 of The Law of Marriage Act, that once a woman and a man lived together, a lawful marriage between them will be presumed.

In the Philippines, the rationale for the presumption of marriage is based on the legal recognition of common-law marriage. In Kenya, common law has been acknowledged as part of the law, and cohabitation has also been included as another form of marriage despite its exclusion in section 3 of the Marriage Act, 2014. The doctrine of presumption can best be understood by referring to section 101 of the Law of Marriage Act, Cap. 29 R.E 2019.

The court further laid down the strict parameters within which a presumption of marriage can be made, including the parties must have lived together for a long time, have the legal right or capacity to marry, and have intended to marry. A lawful marriage between a man and woman who have cohabited for such a length of time and acquired the reputation of being man and wife will be presumed, even if there is no positive evidence of any marriage ceremony having taken place.

The marriage presumption is based on one of the strongest presumptions known to the law that an existing marriage, once shown, is valid. The court also distinguishes between presumption of marriage and long cohabitation as a family forming union not necessary.
