Polygamy, the practice of having multiple spouses simultaneously, is uniformly illegal across all states in the United States. In 2020 and 2021, three Boston-area municipalities became the first to legalize polyamorous marriage. State laws deem polygamy a third-degree felony, punishable with up to five years in prison and a $5,000 fine. However, not many people engaged in polyamory have any legal rights. Multiple U.S. states (including California, Washington, Louisiana, and Rhode Island) have explicitly banned polygamy.
Polygyny is legal in 58 out of nearly 200 sovereign states, the vast majority of them being Muslim-majority countries. Some countries that permit polygamy have restrictions, such as requiring the first wife to give her consent. The legal recognition and protection of throuple and other polyamorous marriages are expanding, albeit slowly.
The Edmunds Act, which punishes bigamy with a fine of not more than five hundred dollars and imprisonment for a term of not more than five years, has been outlawed in federal territories by the Edmunds Act. However, because state laws exist, polygamy is not actively prosecuted at the federal level, but the practice is considered against public policy.
In some cases, cities have broadened the city’s definition of domestic partnerships to include relationships between partners. Some states, like Somerville, Massachusetts, have officially recognized polyamorous relationships. Utah, Montana, and Nevada have also recognized multiple wives, while Maryland is explicitly prohibited.
