Tensions between family traditions and the yearning for independence often arise from disputes over arranged marriages among young Muslims in the U.S.

In Islam, there are two types of marriages: lawful and arranged. Lawful marriages are contracts that do not go against Allah’s orders or the purpose of marriage. In India, arranged marriages are prevalent, as the kinship system, particularly among Hindus in the North, is strongly tied to this system. The process of arranging marriages among Muslims typically begins once individuals reach a suitable age and maturity level. Parents or guardians are responsible for finding a suitable match.

According to the Quran, a married Muslim couple is equated with clothing, and both husband and wife are each other’s protectors. Arranged marriages vary from culture to culture, and while forced marriages are forbidden in Islam, arranged marriages are not. Arranged marriages are not unique to Islam, but they occur in communities where men and women do not mix freely.

Who is in charge of marriage?

Marriage is chiefly regulated by the states. The Supreme Court has held that states are permitted to reasonably regulate the institution by prescribing who is allowed to marry and how the marriage can be dissolved. Entering into a marriage changes the legal status of both parties and gives both husband and wife new rights and obligations. One power that the states do not have, however, is that of prohibiting marriage in the absence of a valid reason. For example, in Loving v. Virginia, the Supreme Court held that prohibiting interracial marriage is unconstitutional because it violates the Equal Protection Clause of the Constitution. Thus, establishing that marriage is a civil right.

The majority of states limit people to one living husband or wife at a time and will not issue marriage licenses to anyone with a living spouse. Once an individual is married, the person must be legally released from the relationship by either death, divorce, or annulment before he or she may remarry. Other limitations on individuals include age and close relationship.

In 1996, President Clinton signed into law the Defense of Marriage Act (DOMA), which, for federal purposes, defined marriage as only a legal union between one man and one woman as husband and wife (1 U.S.C. § 7). DOMA further provided that No State, territory, or possession of the United States, or Indian tribe, shall be required to give effect to any public act, record, or judicial proceeding of any other State, territory, possession, or tribe respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State, territory, possession, or tribe, or a right or claim arising from such relationship (28 U.S.C. § 1738C). (See Conflict of laws, Constitutional law). In the 2013 case United States v. Windsor, the United States Supreme Court struck down DOMA as unconstitutional.

Who is responsible for nikkah?

In most Islamic schools of thought, the Nikah is not valid without the essential role of a wali. Only the Hanafi madhab allows nikah without the presence of the wali, which you can learn more about here. Wali translates to protector, and some Muslims use the word to describe an Islamic saint. A wali is most often a paternal male relative who is in charge of the brides life before marriage. The wali must ensure the well-being of the woman in all aspects of her life; before and during the marriage process. In circumstances as important and life-changing as marriage, it is significantly beneficial for a bride to have assistance from a trusted individual; like her Wali, to settle on the best and most qualified man to be her husband and lifelong partner. A wali should be thorough in evaluating the womans future husband in an unbiased and purely intended manner. After the marriage, the responsibilities of taking care of the woman are lifted off the Wali and the husband becomes responsible for his wifes well-being.

The majority of scholars agree that the wali must be a Muslim. By default, the father of the bride is her wali, however, in certain circumstances where the father is unable to be present as a wali, the role of the wali is usually taken on by the next closest mahram. The most common sequence of the role of the wali after her father is her paternal grandfather, son, grandson, brother, paternal half-brother, and paternal uncle. In a situation where none is available, then the Qadi (Islamic Judge) would assume the title of the wali, or any other righteous relative. The role of the wali is to consent to the marriage and assist the bride during the Nikah. Nikahnama provides an optional space for the walis signature on its marriage contract texts.

  • A lot of people are mistaking arranged marriages with forced marriages. Arranged marriage=both Islamic and cultural, where the parents or carer arrange their child’s marriage and the child has input and the right to refuse. Forced marriages= Haram/forbidden but sadly its part of some peoples culture and its where the children have no choice in who they marry

  • Zubair seems like such a nice guy, theres nothing wrong with being a strict muslim. Theres so few strict muslims nowadays it mint seem strange. My father is a strict muslim and his one of the most chilled people I know. Being a muslim does not make you any less funnier or less of a character. The beard does not stop you living a happy normal life. I wish people could see beyond appearances. I think zubair is a good muslim and seems like a good man too.

He is amazingly funny, he seems sweet, & what a smile!!as for his plans to return to Pakistan, if I could offer some advice-I will be going to Pakistan in June 2015. As an American Non-Muslim ( I plan on converting on our wedding day when I go there, as I want him to be there when it happens:). If you have nothing good or positive to say, the best thing is not to say anything, and certainly not anything about people’s physical appearance etc….   • I’m sorry to say this but Dimpy cannot afford to be so picky. If she wants that perfect guy, then she needs to work on herself too. She should exercise and lose weight. Guys aren’t incredibly picky, but they at least want a woman who is slim and toned, and anyone can achieve that if they work for it. She needs to accept that she needs to make some changes to herself instead of finding faults in every man.

Obviously she is not the ideal from of first glance beauty, but the more you get to know her and see her confidence the more attractive she looks. for crying out loud, she is not hideous, just more average.   • Loved the self esteem of these two Sisters, so different from what I see amongst non-religious friends. Love the idea of parents being the first hurdle in meeting the right person, this seems just what every caring parent should be doing in terms of protecting their child from marrying the wrong person. I honestly wish I had asked my parents what they really thought of the man I married. I think this girl is having a hard time finding a husband because she had a love with her dad that was very strong and no one else is measuring up.   • Asalam o Alaikum to brothers and sisters.. this article is providing me a lot of things knowledge first time.. e.g: Imam had give edu to young age boys and girls lecture about religious education, how practicing of Islam. by lecturs daily. providing them boys data to make a perfect match. I wish that here in Pakistan Imam can do this kind of legal ways efforts to unite young generation by social activities, even the boys only in the mosque. regular Islam learning programs via daily basis clases even for the boys only as like in this article as friendly. but he can try to told only in Jumma khutba.. try to tell us everything in one speach. how we question on it. just listening.. and listening..

  • As a Muslim, (and I must mention that I’m not a practising Muslim, I see myself as a spiritual person), I’m saddened, and in fact surprised to see what an archaic way is followed by our young Muslims to find a partner. And to think that they have been born and grown up in western countries, with their liberal culture and thinking. I don’t for a moment suggest that promiscuity is the answer, but surely, that a 30-odd year old man doesn’t know how to conduct himself in female company…. good heavens! Which world are we living in? Muslims are the most backward people in the world today, and this is one manifestation of it. We have to abandon these archaic ways and adopt a way of life that’s more in keeping with modern times. This is the only way we can return to our glorious past.

  • 2019 – i am writing my comment here in year 2019. But the problem 2012 and 2019 its still same and sadly in 2019 the marriage itself generally in Muslim ummah is more hard. The reason is basically both Muslim men and women have become into perfect match and not realizing their is nothing perfect in match. You have to sacrifice and give up something from your whims and thoughts and desires to get a good person in life. Its obvious but sadly very few people today in Muslim ummah are aware of it. Just don’t be hardcore strict in whatever you want and In sha Allah, you’ll get a spouse easily. But like we seen in this article if people have become hardcore, strict in their approach the chance is they won’t get a match easily. For example in this article two of women had the opportunity to communicate in different level with 60 and 20 people respectively but being too stucked in what they think the person should be, they didn’t get a spouse. and Allah knows the best. But i hope and pray that since its old article from 2012 so till now all of them had been married and Allah would have granted them righteous children as well. If not, we still pray for them and Muslim ummah that may Allah grant them good righteous spouse, ameen.

  • Alright guys, being a Psych major makes me no expert and I may end up having my own struggles in finding a partner. I see that this article is 2 years old, but still these are thoughts I had about 2 of these folks. 1. Br. Zubair’s case is probably the easier one to understand/resolve. It isn’t that he hasn’t found success, and in the article at the end, you can see a sister he liked was interested in him too. His problem/concern is one of a major life decision change. He is planning to move permanently to Pakistan which is a huge decision. Firstly, he doesn’t know what’s waiting for him there and whether he will want to come back to UK. It’s cool to have this desire for a ‘roots’ experience, but when you really get there, you may end up feeling totally different. You think everyone there speaks Urdu, the streets are going to be clean and you will have the secure, convenient life of UK there, when in fact only the Urdu part maybe true and you are running yourself into a totally different culture (even if you have a Pak background). The suggestion is to make one life change at a time and not 2 major changes. He should go to Pakistan first, see how he likes it there and take it from there. Secondly, his chances of finding a UK practicing Muslim girl who would be willing to relocate to Pakistan are very slim. It doesn’t seem like he sees that that’s close to a real impossibility. Unless there is another woman who has the exact same, proactive interest as his and wants to relocate just like him, he is not going to find someone.

What Dimpy said in the end is very true, I’ve seen plenty of girls in my family and in many other muslim families settle for the ugliest guy in the very end when they are over 30. sad but very true. nevertheless hope they all find happiness. inshallah!

  • I love how everyone is complaining about Dimpy`s standards are, but you wouldn’t acknowledge how closed these people from the simple interactions with the opposite sex. These people are very restricted in that type of life. Religious or not, at least have an experience on how the opposite sex is like? It could be just friends, but getting a bit of an overview on how others are like can help them look for a mate much easier. Being closed from the world and then to suddenly open all the doors can be challenging to deal with. I wish them luck though.

  • Damn she’s blaming her dad for her own hangups. My dad joked to me when I was a child to go to law school or doctor and marry and then divorce and take their money. He was just kidding though. He is really progressive for where we live. I met a homeless man and we fell in love and my father really liked him but I never thought once to please my parents and I am religious but I need to be with someone that is my soulmate whether or not my parents approve. My husband was a great amazing man, I would never choose someone that is percieved successful to outside world.   • Personally, I like the beard, and I don’t think that someone with it would be boring. Being very religious isn’t a bad thing, and being slightly less than strictly religious isn’t either. If you’re Muslim, then, sure, there are quite a few things that are unacceptable and quite a few things that are mandatory, but at the end of the day they make you a better person. Islam doesn’t tell you to do anything wrong, it prevents you from doing so. Nobody should avoid religious people. If anything, they should run toward them. Oh, but don’t confuse culture with religion because, sometimes, that happens.

  • Dimple was lying because her father passed 3yrs prior. But she had been looking for 10 yrs. That means her father was alive for 7yrs of her search. Her brother and cousin said she has rejected 60 proposals. You’re not telling me she got all 60 after her fathers death, which means that she was rejecting proposals that her father approved of while he was still present.   • The whole beard concept is mind boggling to me. In my country, I bet anywhere really, if you can rock a beard it’s automatically presumed that you know how to F*** things up!! In better terms, it’s a huge plus so for it to be considered negative seems new and interesting. Perhaps that’s within the Muslim community a few years back then?   • What we had in mind of how our lives should’ve really looked like at the age we’re at now, for many of us it isn’t really the case whilst you see others getting married and shooting out babies every other day, being a Muslim myself I really do sympathise for most women who not only have this pressure at home from their families, but also the community and society they live in who think once you hit a certain age you’re no longer marriage material, not too mention you’re up against a biological clock ticking away inside you and suddenly the haunting thought of having kids at 40+ hits you. As for the brother with the beard, there’s nothing wrong with you or the way you look I mean you ain’t the first man on earth with a beard, you’re demands are abit much, if you’re looking to settle in Pakistan after marriage, then maybe looking for someone out there would be best.

It seems it went from “bullies” to “cyber bullies” one thing has not changed- they still spew their venom.
