Can You Get Deposit Back From Wedding Venue?

If you have paid a deposit for your wedding but it has been canceled, you may be wondering how to get your deposit back. Most venues will fully refund the deposit if you cancel with enough notice and they can rebook your date for the same price. However, if you cannot, you may forfeit the deposit and possibly the entire site fee.

If your wedding contract states that the deposit is non-refundable, you can ask the venue to cancel the wedding and ask if there is any chance of getting some of your deposit back. If you think you have paid a deposit and can’t get it back, you may need to consider a force majeure clause to get your deposit back. Under New York law, an act of God is a phenomenon that is out of your control, such as a hurricane, snowstorm, or coronavirus outbreak. By stating a force majeure clause, the venue is likely entitled to all the money that the venue will be entitled to (even if the expectation damages).

When reserving a wedding venue, you should expect to pay a deposit that ranges from 25 to 50 percent of the total cost of the event. If the venue doesn’t agree to any of these options, you can file a claim with your insurance. If you insist on having an attorney review the contract, plan on spending more than the $300.00 deposit just for contract review. A deposit is part of the total cost of something or an advance payment made at the time of booking.

Venues are allowed at licensed venues with no numerical limit on guests, but must assess how many people they can safely fit in. They can accommodate up to 10 people per table and 15 people from three households in private gardens. If you paid for part or all of the venue fee by credit card, you can make a Section 75 claim, which makes your credit card provider equally liable for your losses as long as the value of what you bought is between $5k-$9k. If you cancel your wedding and the venue can re-book your date at the same price, most venues will refund the deposit in full. However, if an attendee causes damage and the venue has proof, they may be able to issue a full refund. Most venues would be unlikely to issue a 100% deposit refund for a cancellation regardless of how far in advance the cancellation is.
